The following words and phrases have these meanings in this document:
1.1. "POPI" means the Protection of Personal Information Act 4 of 2013.
1.2. "PII" means the Personally Identifiable Information" and has the same meaning as defined by "Personal Information" in POPI.
1.3. "Process" concerning Personal Information means to collect, organise, store, modify, retrieve, refer to, distribute, or erase, or otherwise as defined in POPI.
1.4. Baobab Web Services (Pty) Ltd ("BWS", "Us", "We" or "Our") a company incorporated in terms of the company laws of the Republic of South Africa. Address: 35-38 Buena Vista Office Park, 1 Heuwelkruin Close, Eversdal, 7550, Western Cape, South Africa. Email: firstname.lastname@example.org.
1.6. "You" or the "user" means any person who accesses the Website for any purpose.
3.1. Like most Websites, BWS collects Non-Personally Identifiable Information (Non-PII) of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring Website, and the date and time of each visitor request.
3.2. BWS' purpose in collecting Non-PII is to understand better how BWS' visitors use BWS' Website. From time to time, BWS may release Non-PII in the aggregate, e.g., by publishing a report on trends in the usage of its Website.
4.1. Where you submit PII via the Website, the following principles are observed in the handling of that Information:
4.1.1 BWS will only collect PII for a purpose consistent with the purpose for which it is required. The specific purpose for which information is collected will be apparent from the context in which it is requested.
4.1.2 BWS will only process PII in a manner that is adequate, relevant and not excessive in the context of the purpose for which it is processed.
4.1.3 PII will only be processed for a purpose compatible with that for which it was collected unless you have consented to alternative use in writing, BWS is permitted by POPI or in terms of national legislation of general application.
4.1.4 BWS will not disclose any PII relating to you to any third party unless your prior written agreement is obtained or BWS is required to do so by law.
4.1.5 BWS will destroy or delete any PII that is no longer needed by BWS for the purpose it was initially collected, or subsequently processed.
4.2. Note that, as permitted by POPI, BWS may use PII collected to compile profiles for statistical purposes. No information contained in the profiles or statistics will be able to be linked to any specific user.
4.3. BWS discloses potentially PII only to employees, contractors and affiliated organisations that:
4.3.1 Need to know that information to process it on BWS' behalf or to provide services available at BWS' Website; and
4.3.2 That have agreed not to disclose it to others. Some of those employees, contractors and affiliated organisations may be located outside of your home country; by using BWS' Website, you consent to the transfer of such information to them.
4.3.3 BWS will not rent or sell PII to anyone.
4.3.4 Other than to employees, contractors and affiliated organisations, as described above, PII is only disclosed in response to a subpoena, court order or other governmental requests. PII may also be disclosed when BWS believes in good faith that disclosure is reasonably necessary to protect the property or rights of us, third parties or the public at large.
4.4. Registered Website users, may occasionally receive an email to be informed about new features, to solicit feedback, or just to be kept up to date with what's going on with BWS and BWS' products. Users may opt-out of this service.
4.4.1 BWS primarily uses a blog to communicate this type of information, so BWS expects to keep this type of email to a minimum. If you send BWS a request (for example via a support email or one of BWS' feedback mechanisms), BWS reserves the right to publish it to help BWS clarify or respond to your request or to help BWS support other users.
4.5. BWS takes all reasonable measures necessary to protect against the unauthorised access, use, alteration or destruction of potentially PII.
5.1. BWS may use standard technology to collect information about the use of this Website. This technology is not able to identify individual users but simply allows BWS to compile aggregated statistics.
5.2. BWS may utilise temporary or session cookies (a cookie is a small file placed on your hard drive) to keep track of users' browsing habits. A cookie allows BWS to track your use of this Website as well as your visits to other websites. Other websites may also use these cookies to track your browsing behaviour.
5.3. Cookies by themselves will not be used to identify users. Still, BWS may use them to compile de-identified statistics relating to the use of services offered or to provide BWS with feedback on the performance of this Website.
5.4. The following classes of information may be collected in respect of users who have enabled cookies:
5.4.1 The browser software used;
5.4.2 IP address;
5.4.3 Date and time of activities while visiting the Website;
5.4.4 URLs of internal pages visited; and
5.4.5 referring websites, search engines and the like.
5.5. If you do not wish cookies to be employed to customise your interaction with this Website, it is possible to alter how your browser handles cookies. Please note that, if this is done, certain services on the Website may not be available to you.
6.1. BWS will take appropriate, reasonable technical and organisational measures as required by the applicable law to protect the information submitted to or collected by this Website from loss, misuse, unauthorised disclosure, alteration or destruction.
8.1. If BWS, or substantially all of BWS' assets, were acquired, or in the unlikely event that BWS goes out of business or enter bankruptcy, user information would be one of the assets that are transferred or acquired by a third party. You acknowledge that such transfers may occur and that any acquirer of BWS may continue to use your personal information as in this policy.
9.2.1 Google advertisement preferences can be set via the Google Ad Preferences page. Interest-based advertising can be opted-out entirely either by cookie settings or using available browser plugins.
10.1. Those who engage in transactions with BWS – by purchasing services or products - are asked to provide additional information, including the personal and financial information required to process those transactions.
